Freedom of Information

The Freedom of Information Act 1991 (SA) gives individuals the right to access documents (subject to certain exemptions) within Council’s possession. It also allows a person to apply to the Council for the amendment of the Council’s records if the document contains information concerning the person’s personal affairs; the information is available for use by the Council in connection with its administrative functions; and the personal information is incomplete, incorrect, out of date or misleading.

Various Council documents are publicly available and do not require an Freedom of Information (FOI) application.  Documents available on this website include: Council and committee minutes and agendas, Council adopted policies and procedures, strategic management plans, registers and returns, codes of conduct, codes of practice, by-laws, annual reports and development applications (available for viewing during the public consultation period in accordance with the Development Act 1993).

To request access to documents not publicly available, please complete an FOI Application form- Request for Access or provide a written request which must:

  • be accompanied by the prescribed application fee (if applicable)
  • contains such information as is reasonably necessary to enable the documents to be identified
  • specify an address in Australia to which notices should be sent and
  • be lodged at an office of the Council.

The FOI application or written request with the application fee must be either hand delivered to one of our Council offices or posted to the principal office (City of Onkaparinga, PO Box 1, Noarlunga Centre SA 5168).

There are additional fees associated with processing an FOI application (in addition to the application fee) as prescribed in the Freedom of Information (Fees and Charges) Regulations 2003.  Please refer to the Council's Schedule of Schedule of fees and charges for details. Please note no fees apply for concession card holders (excluding postage).
